In view of the letter dated 09.10.2017, filed by the learned counsel for the petitioner before the Registry, seeking permission of this Court to withdraw the criminal petition with a liberty to file a fresh quash petition, permission for withdrawal is accorded.

Accordingly, this criminal petition is dismissed as withdrawn with the liberty as prayed for. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
