HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRL.M.P.NO.5750 OF 2015 AND CRIMINAL PETITION No.5762 OF 2015 COMMON ORDER:

This Criminal Petition is filed by the petitioners/A1 to A4 under Section 482 Cr.P.C seeking to quash the proceedings in C.C.No.199 of 2015 on the file of II Additional Junior Civil Judge, Nuzvid, Krishna District, where the cognizance was taken for the offence punishable under Section 498-A I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, which is an outcome of the report of the defacto complainant/2nd respondent herein vide crime No.176 of 2011 of Hanuman Junction Police Station, Krishna District.

Heard the learned counsel for the petitioners and the learned counsel for respondents.

Pending the Criminal Petition, the de facto complainant filed Crl.MP.No.5750 of 2015 seeking permission of the Court to compound the offence in the above said C.C.

The de facto complainant and the accused are present before the Court and they identified by their respective counsel and stated that they settled the matter outside the Court amicably as per the memorandum of compromise dated 13.06.2015 and mutual consent divorce petition in O.P.No.199 of 2015 on the file of Senior Civil Judge, Nuzvid is pending and the petitioners/accused agreed to pay Rs.1,75,000/- to the de facto complainant and the same is given in open Court to her by way of demand draft bearing No.258472 dated 10.06.2015. Though the offence under Sections 3 and 4 of the Dowry

Prohibition Act are not compoundable under Section 320 Cr.P.C. by invoking Section 482 Cr.P.C. the same are compounded. Accordingly, Crl.M.P.No.5750 of 2015 is ordered and the Criminal Petition is allowed by quashing the proceedings in C.C.No.199 of 2015 on the file of II Additional Junior Civil Judge, Nuzvid, Krishna District.

Miscellaneous petitions pending if any, shall stand closed.
