HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.1471 of 2018 Order:

The petitioner states that she purchased an extent of Ac.2-00 of agricultural land situated in Survey No.644/2 of P. Mallavaram village, Tallarevu Mandal, East Godavari District when she was a minor under a registered document dated 23.09.2004. The possession of the said property was also delivered to her. Her father died at a young age and her mother purchased the said land in her name. Her marriage was performed recently in the year 2017. In spite of pursuing the matter for mutation of her name, when no action was taken, she filed an application to the fourth respondent for surveying the land and for fixation of boundaries so as to update the revenue records. Accordingly, survey was conducted on 12.07.2017 and an endorsement was issued on 13.07.2017. Thereafter, another application was filed on 13.10.2017 in Form-6A for issuance of pattadar passbook and title deeds and when no action was taken, the present Writ Petition is filed.

The fourth respondent, in his written instructions issued to the learned Government Pleader, referred to the brief facts of the case leading to the issuance of endorsement dated 09.01.2018, but did not refer to the application of the petitioner dated 13.10.2017 for issuance of pattadar passbooks and title deeds pursuant to the survey already conducted and for which an endorsement was issued on 09.01.2018. It is unfortunate that the fourth respondent has not applied his mind while giving instructions to the learned Government Pleader. Since the petitioner submitted an appropriate application consequent to the survey and the claim is based on a registered sale

deed, the fourth respondent is directed to consider the application of the petitioner dated 13.10.2017 and pass appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs.
