11.03.2025 JSR,J I.A.No.2 of 2025 This application is filed invoking the provisions of Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') seeking relaxation of the conditions imposed against the petitioner while granting bail.

Ms.Devara Samhitha, learned counsel for the petitioner submitted that this Court while granting anticipatory bail to the petitioner/accused No.2, directed the petitioner to surrender before the Station House Officer, KPHB Colony Police Station, within two weeks and requested this Court to extend the time on the ground that the petitioner is residing in Dubai.

She further submitted that this Court also directed the petitioner to appear before the concerned S.H.O. on every Monday between 9-00 A.M. to 10-00 P.M. for a period of eight weeks or till filing of charge sheet, whichever is earlier. She submitted that even prior to disposal of the Criminal Petition No.697 of 2025 by this Court on 29.01.2025, the Investigating Officer after completing the investigation filed charge sheet before the concerned Court on 30.12.2024 vide

OFFI CE NOTE inward No.3033 of 2024. Hence prayed to relax the said condition and extend the time to surrender before the concerned S.H.O. and to obtain bail. Mr.Syed Yasar Mamoon, learned Addl. Public Prosecutor has not disputed the same.

Taking into consideration the averments made in the application and the submission made by the learned counsel for the petitioner that the petitioner is living with her minor child in Dubai, and the police filed charge sheet, this Court is inclined to allow this application.

Accordingly, this application is ordered and modified the condition No.(i) as follows:

"The petitioner shall surrender before the Station House Officer of KPHB Colony Police Station, Cyberabad, Medchal Malkajgiri District, Kukatpally, Telangana, on or before 18.04.2025 and on such surrender, the said Station House Officer shall release her on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each."

Insofar as condition No.ii, it is hereby relaxed. _______ JSR,J Pgp
