HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE MS. JUSTICE J. UMA DEVI Writ Petition No.408 of 2017 ORDER: (per Hon'ble Sri Just ice V. Ramasubramanian) The petitioner has come up with the present writ petition seeking a very limited relief, namely, to direct the respondents to permit him to clear the arrears of interest on the duty of excise, in 18 equal monthly installments.

2. Heard Sri K. Raji Reddy, learned counsel for the petitioner and Sri M.V.J.K. Kumar, learned Special Standing Counsel for the respondents.

3. In view of the nature of the relief prayed for, it is not necessary for us to get into the factual and legal details. The petitioner has explained the financial circumstances, which made them unable to pay the interest portion from 2013 onwards.

4. Today admittedly they have let out a property fetching rental income of Rs.2.00 lakh. Therefore, the writ petition is disposed of directing the petitioner to pay the arrears of interest in equal monthly installments at the rate of Rs.2.00 lakh. The first of such installment shall be paid on or before 15th of February, 2017 and all subsequent installments shall be paid on or before 10th of every succeeding English calendar month. In case of default on the part of the petitioner, it will be open to the respondents to take coercive action. There shall be no order as to costs. Pending

miscellaneous applications, if any, in this writ petition, shall stand closed.
