N. Premlataha, v. G. Gopal,
THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.2173 of 2016 ORDER:
This contempt case was instituted alleging wilful disobedience to the order dated 25.02.2016 passed by this Court in W.P.No.6149 of 2016. By the said order, this Court directed the authorities, and more particularly the Greater Hyderabad Municipal Corporation, to consider the petitioner's representation dated 05.08.2015, whereby she sought inclusion of her name in the list of beneficiaries under a housing scheme and for allotment of a suitable house/flat. This exercise was directed to be completed expeditiously and the result thereof had to be communicated to the petitioner.
Ms.N.Premalatha, petitioner/party-in-person, informed this Court that pursuant to the aforestated order, the Revenue Divisional Officer, Secunderabad Division, Government of Telangana, issued endorsement dated 13.12.2016, whereby he considered the petitioner/party-in-person's application dated 05.08.2015 and rejected the same. In the light of the aforestated development, this Court finds no disobedience, much less wilful disobedience, to the order dated 25.02.2016 passed in W.P.No.6149 of 2016 warranting exercise of contempt jurisdiction. In the event the petitioner/party-in-person is aggrieved by the endorsement dated 13.12.2016, she would necessarily have to challenge the same by way of independent proceedings in accordance with law.
Reserving liberty to the petitioner/party-in-person to do so, the contempt case is closed. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date:03.03.2017 GJ
