THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1590 of 2019 O R D E R:

In this writ petition, the limited grievance of the petitioner is that respondent No.3-Station House Officer, Utnoor Police Station, Adilabad District has not made over the seized vehicle of petitioner to the custody of respondent No.2-Deputy Commissioner of Excise, Utnoor, as the same is involved in excise offence. In the circumstances, he prays for a writ of mandamus questioning the inaction on the part of respondent No.3 in forwarding the file in Crime No.287 of 2018 to respondent No.2.

Heard learned counsel for the petitioner and learned Government Pleader for Prohibition & Excise for the respondents. Having regard to the limited prayer of the petitioner, the writ petition is disposed of with the direction to respondent No.3 to forward the file in Crime No.287 of 2018 to respondent No.2 to enable him to consider the case of the petitioner in terms of Section 34 of the Telangana Excise Act.
