THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.20169 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking following relief:
"to issue Writ of Mandamus declaring the action of the respondents herein in not considering the petitioners' application dated 02-04-2015 for grant of minority status as illegal, arbitrary and unconstitutional and consequently direct the respondents to treat the 2nd petitioner institution as a Muslim minority institution for the future academic years commencing from 2015-16 and permit the 2nd petitioner institution to make admissions as a Minority Educational Institution." Heard Sri Rubaina S. Khatoon, learned counsel for the petitioners and learned Government Pleader for respondents. During the course of hearing, it is represented by the learned counsel for the petitioners that in identical set of circumstances this Court passed an order in writ petition No.15784 of 2013 and the copy of the same is placed on record along with the writ petition as material paper. Therefore, this Court deems it appropriate to dispose of the present writ petition also in the same lines.
Following the above mentioned order and for the reasons recorded therein, this writ petition is disposed of directing the respondents 1 and 2 to consider the claim of the petitioners for grant of minority status as requested in the application said to
have been made by the petitioners on 02-04-2015, in accordance with law, and communicate the same to the petitioners within a period of two (2) weeks from the date of receipt of a copy of this order.
The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
