HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.14931 OF 2017 ORDER:

The writ petition is filed declaring the action of the respondents in dispossessing the petitioners from their plots owned by them without following due procedure under law as illegal and arbitrary and consequently direct the respondents to desist themselves from proceeding further without initiating any acquisition proceedings as per the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

It is submitted by the learned counsel for the petitioners as well as the learned Government Pleader that in similar circumstances arising out of identical proceedings in respect of the same village, this Court disposed of W.P.No.5638 of 2017, by order dated 03.03.2017, recording the statement of the learned Government Pleader stating that if the lands of the petitioners are acquired for public purpose, the respondents will follow due process of law.

In view of the above, this writ petition is also disposed of recording the statement of the learned Government Pleader that if the lands of the petitioners are required for public purpose, the respondents will follow due process of law and without following the same, the petitioners' possession shall not be disturbed.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 16.08.2017 pln
