HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6221 of 2017 ORDER:
Heard the learned counsel for the petitioners/ A.2 to A.4 out of 4 accused of Cr.No.102 of 2017 of Tenali I Town Police Station, Guntur, registered for the offences punishable under Sections 419,420,468, 471 and 120-B r/ w 34 IPC, and also heard the learned Public Prosecutor representing 1st respondent-State before ordering notice to the 2nd respondent and perused the First Information Report and grounds urged in the quash petition. As the investigation is at nasal stage, for this Court there is nothing to interdict the investigation.
Having regard to the above, the Criminal Petition is disposed of without prejudice to any future defence of the petitioners. Needless to say if at all any arrest is required, the police shall follow Section 41-A of CrPC, and also the guidelines in Arnesh Kumar Vs. State of Bihar1.
Consequently, miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
