THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.11509 of 2015 ORDER:
1. This writ petition is filed challenging the inaction of the 4th respondent-Bank in releasing the gratuity and leave encashment of the petitioner.
2. It is stated that the petitioner retired on 30.4.2013 as Staff Assistant at Devarakonda Branch of the 4th respondent-Bank. The 4th respondent-Bank did not pay the amounts of leave encashment for three months and gratuity to the petitioner. It is stated that earlier, a notice was given on 2.4.2013 to the petitioner informing him to clear off the arrears of rents for his residence at 5th respondent on or before 25.4.2013. The petitioner obtained no due certificate from the 5th respondent. He made representation on 15.11.2014 to the 4th respondent seeking release of his retirement benefits and informing that his kidneys failed and he is surviving on dialysis. In spite of his another representation on 8.4.2015 to release his retirement benefits, there is no response from the 4th respondent. Hence, the petitioner approached this Court.
3. Heard and perused the material available on record.
4. Considering the above facts and circumstances of the case, without expressing any opinion on the merits of the case, the Writ Petition is disposed of with the following direction:
"The 4th respondent is directed to consider the representation of the petitioner, dated 15.11.2014 and pass appropriate orders, within a period of 15 days from the date of receipt of a copy of this order. If the 4th respondent fails to dispose of the representation of the petitioner within the period stipulated above, the petitioner is at liberty to approach this Court."
No order as to costs. Consequently, the miscellaneous petitions pending, if any, shall stand closed.
