HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.6296 OF 2017 ORDER:

This writ petition is filed for a writ of mandamus declaring the impugned endorsement in Rc.A/125/2015 dated 21.02.2016, issued by the 4th respondent, in pursuant to the application made by the petitioner for issuance of pattadar passbook and title deeds in respect of the land admeasuring Ac.6.86 cents out of Ac.16.83 cents in Sy.No.309, situated in Somireedipalle Village.

Bramamgarimatam Mandal, YSR Kadapa District, as illegal and arbitrary.

Learned counsel for the petitioner submits that before passing the impugned endorsement dated 21.02.2016, the petitioner was not issued prior notice, which is in violation of principles of natural justice.

Heard the learned Assistant Government Pleader for Revenue.

In view of above facts and circumstances, without going into the merits of the case, the impugned proceedings in Rc.A/125/2015 dated 21.02.2015 is set aside and the 4th respondent is directed to consider the application of the petitioner made for issuance of pattadar pass book and title deeds in respect of the subject land in accordance with law, after issuing notice to petitioner and opportunity of hearing.

The writ petition is allowed to the extent indicated above. No costs.
