THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.3529 OF 2007 ORDER:

This Writ Petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue an appropriate writ order or direction preferably one in the nature of writ of mandamus declaring the action of the respondents in not considering the request of the petitioner for allotment of alternate suitable post in pursuance of his representations dated 18.1.2006 and 28.1.2006 having regard to his physical condition as arbitrary, illegal, and contrary to law and consequently direct the respondents herein to consider the case of the petitioner for any suitable alternative light job in Border Security Force forthwith."

Heard Sri Kusuri Satyanarayana, learned counsel, appearing for the petitioner and Smt.K.Mani Deepika, learned additional standing counsel for the Union of India, appearing for the respondents.

This Court, while ordering 'Rule Nisi' on 23.02.2007, granted interim direction in W.P.M.P.No.4496 of 2007, directing the respondents to consider the representations purported to have been made by the petitioner on 18.01.2006 and 28.01.2006, within a period of six weeks from the date of receipt of this order.

No counter affidavit is filed.

It is stated by the learned counsel appearing for the petitioner that, despite above orders of this Court, no orders have been passed so far on the said representations made by the petitioner.

In view of the same and in view of the absence of any counter, this writ petition stands disposed of, making the interim order granted earlier by this Court on 23.02.2007 as final order in the writ petition and the respondents are directed to consider the representations purported to have been made by the petitioner on 18.01.2006 and 28.01.2006, within a period of eight weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
