THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.5892 of 2016 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue.
The petitioners state that they are the absolute owners and possessors of the land admeasuring Ac.0.33 guntas in Survey No.199 of Devanpally Village, Kamareddy Mandal, Nizamabad District. They made an application, dated 17.11.2015, before the Tahsildar, Kamareddy Mandal, Nizamabad District, the 3rd respondent, under Form VI-A of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act') and the Rules framed thereunder for grant of pattadar passbooks and title deeds and paid the requisite fee to that effect. Alleging that no action is taken by the 3rd respondent, the present Writ Petition is filed. It is evident that the proceedings under Form VI-A of the Act are required to be considered in a time span of 45 days. Considering the fact that the statutory application of the petitioners is pending since 17.11.2015, the 3rd respondent is directed to consider the said application and pass appropriate orders, expeditiously, preferably within a period of four weeks from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition
shall stand closed.
