THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.34113 OF 2017 ORDER:

Heard the learned counsel for the petitioner and the learned Govt. Pleader for Home and Revenue for respondents 1 to 4 though the learned standing counsel for the Panchayat for 5th respondent offered already and his name is printed but no vakalath filed so far but for heard to assist the Court and perused the prayer in the writ petition with the supporting affidavit and the material on record.

The prayer in the writ petition reads as follows:- " to issue any Writ, order or direction more particularly a Writ in the nature of Writ of Mandamus and direct the Respondents specifically the 2nd respondent to extend necessary help and protection to the Petitioner company to enable it to evacuate/ eject the unauthorized occupants who are squatting on the land under which the effluent discharge pipes of the Petitioner company are existing in order to enable the Petitioner company to lay new pipe line to avoid the contingency of the pipes getting burst in the larger public interest and in the interest of public safety and to pass such other order or orders" 3.

However the interim applications vis-à-vis the supporting affidavit clearly speaks the assistance of the respondents respectively to the petitioner(s) for replacement of the underground pipelines which are in dangerous condition being used for discharge of the effluents from the Industry premises of the petitioner.

Having regard to the above, the Writ Petition is disposed of by giving liberty to the petitioner to make a representation particularly to the respondents 2 to 5 to provide necessary assistance for replacement of the pipelines which are in dangerous condition now being used for discharge of the effluents from the Industry premises of the petitioner and the respondents to consider and provide.

Consequently, miscellaneous petitions, if any, in this revision shall stand closed.
