THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.2313 OF 2009 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue appropriate writ or order or direction more particularly one in the nature of Writ of Mandamus declaring action of the respondents in evicting the petitioners from their lands to an extent of Hec.0.35 and 0.76 cents in Sy.Nos.94/02 and 94/03 of Devaram Village, Devipatnam Mandal, East Godavari District without issuing any notice or passing any order as illegal, arbitrary and in violation of principles of natural justice and also violative of Art.14, 21 and 300A of the Constitution of India and consequently direct the respondents not to dispossess the petitioners from their lands without following due process of law in the interest of justice."

The main grievance of the petitioners is that the respondents are trying to dispossess them from the subject lands without following the due process of law.

Heard and perused the material available on record. 4.
On 10.02.2009, this Court passed an interim order in W.P.M.P.No.2948 of 2009 directing the respondents not to dispossess the petitioners from their respective lands without following the due process of law. Considering all the facts and circumstances of the case, the said interim order is made absolute and the Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
