HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27815 OF 2016 ORDER:

The case of the petitioner is that the APIIC allotted plot No.147 admeasuring 200 Sq.Yards in Survey No.74/7 of Industrial Park, Auto Nagar, Tirupathi to the petitioner, his father and brother and executed registered sale deed bearing document No.1976/2000 dated 05.03.2000. In the said plot the petitioner is carrying on business in the name of M/s.Pasuparthy Lubricants. While so, when the petitioner wants to sell the said plot to M/s.Gajendra Auto Garage, he obtained NOC from APIIC and presented the sale deed for registration before the 4th respondent. Then the 4th respondent informed the petitioner that they have stopped registration in respect of lands in Sy.No.74. It is also stated that the facts in the present case are similar to that of WP.No.14439 of 2011 and this Court in WP.No.14439 of 2011 held that the respondents have no right to prevent the petitioner from enjoying his absolute rights, vis-à-vis the land in any manner. It is further stated that in respect of the subject land WP.Nos.15215 of 2015 is disposed off and 19479 of 2013 is allowed as follows;

"For reasons alike as were mentioned in the order dated 25.07.2012 passed by this Court in WP.No.22642 of 2012, this writ petition is allowed directing the 4th respondent to receive and process the documents presented by the petitioners in respect of the subject plots. In the event the said documents are found to fulfill the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the 4th respondent shall complete the registration formalities and release the documents in accordance with the due procedure."

The facts in the present writ petition show that the same are covered by the Judgments relied on by the petitioner. In view of the same, the writ petition is allowed directing the 4th respondent to receive and process the documents presented by the petitioner in respect of the subject property. In the event the said documents are found to fulfill the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the 4th respondent shall complete the registration formalities and release the documents in accordance with the due procedure. With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
