O R D E R
This writ petition is filed for a writ of mandamus declaring the action of the 1st respondent in not sanctioning the Credit Loan to the petitioner vide his letter dated 09.12.2002, as illegal and arbitrary. While admitting the writ petition, this Court granted interim order on 30.12.2002 in WPMP.No.32421 of 2002 directing the respondents to sanction the loan to the petitioner which is repayable by him before October, 2003 for medical assistance.
Counter affidavit is filed by the respondents stating that in compliance of the interim orders granted by this Court on 30.12.2002, though the respondents issued proceedings dated 10.01.2003 vide Lr.No.CCS/14/10683/2003 offering release of the loan to be paid before October, 2003, the date of retirement on superannuation of 58 years as per Service Rules of the Society and requested him to submit the loan application as per the Rules, the petitioner failed to respond to the same.
No reply affidavit is filed.
In view of the above, the cause in the writ petition no longer survives for adjudication, since it is stated that the petitioner has retired from service on attaining the age of superannuation.
Accordingly, the writ petition is dismissed as infructuous. No costs. As a sequel, miscellaneous petitions pending if any, shall stand closed. ____________________________ A.RAJASHEKER REDDY,J Date: 01.10.2015 dv
