THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.14187 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the action of Respondents in not reckoning/considering the period of service of first appointment dated 01.05.1987 for the sake counting the period of service in the post of Accountant as illegal arbitrary, unconstitutional, violative of Article 14 and 21 of the Constitution of India and consequently direct the Respondents to count the period of service from 01.05.1987 for the sake of computation of retirement/terminal benefits."
Heard Sri Ch. Venu Kumar, learned counsel for the petitioner and Sri Deepak Bhattachargi, learned Standing Counsel for respondent No.1 and learned Government Pleader for Higher Education for respondent No2.
When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 0112-2015 to the 1st respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 1st respondent to pass appropriate orders on the representation, dated 01-12-2015, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Standing Counsel for respondent No.1 and submitted that the said representation would be considered, in accordance with law.
For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 1st respondent to consider and pass appropriate orders on the representation, dated 01-12-2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of two
(2) months from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
