HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21451 OF 2016 ORDER:

This petition is filed for a writ of Mandamus declaring the notice dated 17.06.2016 issued by the 5th respondent to the petitioners, as illegal and arbitrary and for a consequential direction to the respondents 1 to 5 not to survey and demarcate the lands in Sy.No.189 and 228 of Reddypally Village, Narsapur Mandal, Medak District of the petitioners without following the due process of law and without giving prior notice as required under Survey and Boundaries Act.

Learned counsel for the petitioners submits that without following due procedure the respondents issued the impugned notice.

Learned Assistant Government Pleader for Revenue on instructions submits that survey was already conducted and completed in respect of the subject lands. In view of the same, no relief can be granted in this writ petition. However, if the petitioners are aggrieved by the said survey it is open for them to challenge the same by way of appropriate proceedings.

Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
