This petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused, in Crime No.113 of 2017 on the file of PS CCS, Hyderabad. The offence alleged is under Sections 406 and 420 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

Counsel for the petitioner submits that earlier petition, seeking for grant of anticipatory bail, was allowed by Special Judge for Economic Offences-cum-VIII Additional Metropolitan Sessions Judge, Hyderabad by virtue of order dated 08.11.2017 in Crl.M.P. No.3364 of 2017. But when the petitioner went to furnish sureties before the concerned SHO, the SHO refused to accept the sureties stating that the matter was transferred to PS CCS, Hyderabad. Later, another petition was filed before the same Court for grant of anticipatory bail and the same was dismissed by considering the merits of the case, observing that the accused did not return the cheque amount to the complainant. Relying on the earlier order allowing the petition, the petitioner herein filed the present petition. 4.

A perusal of the dismissal order shows that the accused did not return the cheque amount to the complainant. 5.

Hence, this Court is of the same opinion, this Criminal Petition is dismissed. However, the petitioner can file a petition

seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
