SMT JUSTICE T.RAJANI CRIMINAL PETITION NO.423 OF 2018 ORDER:
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioners, who are A-8 and A-11 in Crime No.280 of 2015 on the file of the Station House Officer, Manchal Police Station, Ranga Reddy District. The offences alleged are under Sections 406, 420, 468 and 471 read with Section 120-B of the Indian Penal Code.
The case of the prosecution is that several persons created false and fabricated documents and obtained loans and the present petitioners are among them. Learned Public Prosecutor submits that bail petitions filed by some of the accused were dismissed by this Court by considering the merits of the case.
Considering the facts and circumstances and nature of allegations, this Court opines that it is not a fit case for grant of anticipatory bail to the petitioner.
At this juncture, learned counsel for the petitioners requested to issue direction to the police concerned to follow the procedure contemplated under Section 41-A Cr.P.C. and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar1.
Acceding to the request of the counsel for the petitioners, this Criminal Petition is dismissed directing the police concerned to follow the procedure under Section 41-A Cr.P.C. 1 (2014)8 SCC 273
and the guidelines issued by the Apex Court in Arnesh Kumar1. Miscellaneous petitions, if any, pending shall stand dismissed.
