HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.505 of 2015 ORDER:
The writ petition is filed alleging harassment, intimidation and recovery of alleged loans due from the petitioner. By way of interim order in W.P.M.P.3892 of 2014 in W.P.No.3171 of 2014 stay of all further proceedings was sought in furtherance to the seizure notice dated 12.11.2013. This Court by order dated 05.02.2014 granted interim stay as prayed for.
2. In terms of the order passed by this Court there cannot be seizure of vehicle as originally proposed in the proceedings dated 12.11.2013.
3. Learned counsel for the petitioner contends that respondents are sending gundas, notices and messages to the mobile phone of the petitioner demanding payment of amounts due.
4. As noticed above, the order of this Court is only with regard to seizure of vehicle. Any other aspect with reference to the loan account of the petitioner is not covered by the direction issued by this Court. In contempt proceedings the Court is only concerned with violation of order passed by this Court. Admittedly, the vehicle is not seized after the interim orders are passed.
5. Thus, there is no merit in the allegations that the authorities of the respondent-Bank have committed contempt.
6. Accordingly, contempt case is closed. It is needless to observe that the petitioner can avail appropriate remedies against any other issue regarding the concerned loan account. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
