HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.21854 OF 2001 ORDER:

When the matter is taken up for hearing, counsel for the petitioner submitted that the Authority under the A.P. Shops & Establishments Act has granted the relief of Rs.55,000/- to the 3rd respondent - Workman and this Court, while admitting the writ petition, has granted interim suspension subject to the condition that the petitioner deposits 50% of the awarded amount.

The issue is only about the payment of the remaining 50% of the awarded amount to the 3rd respondent - workman. This Court is of the considered view that ends of justice would be met if the balance 50% of the awarded amount is also directed to be paid to the workman.

In view of the peculiar facts and circumstances of the case, this Court is not inclined to interfere with the orders passed by the Authority under the Shops & Establishments Act and the writ petition is liable to be dismissed.

Accordingly, the writ petition is dismissed and the petitioner is directed to pay the remaining 50% of the awarded amount to the workman within a period of four weeks from the date of receipt of a copy of this order. No order as to costs.
