HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY Writ Petition No. 7651 of 2009 ORDER :

This writ petition is filed seeking writ of mandamus declaring the action of the 4th respondent in contemplating to conduct auction scheduled to be held on 16.04.2009 at 10.00 A.M in the premises of the 4th respondent temple over the land to an extent of Ac.3.73 cents in Sy.Nos.816, 52/3, 61/B, situated at Minagallu village, Butchireddipalem Mandal, Sree Potti Sreeramulu Nellor District, through the impugned notification dated 06.04.2009 issued by the 4th respondent, without tom-tom in the village as illegal and arbitrary.

Though this writ petition was admitted on 17.04.2009, no interim order was passed.

3. Sri A.Srikanth Reddy, learned Standing Counsel for the 4th respondent submits that the cause in the writ petition does not survive for consideration.

4. The impugned notification dated 06.04.2009 was issued for granting of leasehold rights in respect of the subject land for a period of three years and the said period has expired by efflux of time.

In view of above, this writ petition is dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any pending in this Writ Petition, shall stand dismissed.
