HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.14340 of 2014 ORDER :

This Criminal Petition is filed by the Petitioner who is vehicle owner seeking to release the tractor bearing No.AP 26 AX 4236 of Duttalur Police Station.

2) As the F.I.R ingredients in Crime No.75 of 2014 of Duttaluru Police Station, SPSR Nellore District registered for the offences punishable under Section 395, 447 and 506 I.P.C. The allegations are that the tractor mentioned supra has taken by the accused high handedly without informing the petitioner and when the petitioner approached the accused they did not heed the words of the petitioner, that the petitioner came to know the said vehicle sold to others without informing the petitioner. In the present petition the two accused of the crime, who said to have been seized the vehicle, though necessary party, not impleaded and hence the petition is liable to be rejected.

3) In the result, the petition is rejected giving liberty to the petitioner to file a fresh petition with necessary parties. Consequently the miscellaneous petitions, if any pending, shall stand closed.
