HON'BLE SRI JUSTICE T AMARNATH GOUD CRL.P.No.394 of 2019 ORDER:

This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioners/Accused Nos.4 seeking to quash the proceedings against him in P.R.C.No.22 of 2016 on the file of Judicial Magistrate of First Class, Metpalli. 2.

Heard the learned counsel for the petitioners/Accused No.4, the learned Additional Public Prosecutor representing the respondent-State and perused the record.

Though learned counsel for the petitioner filed the petition for quashing the proceedings in the aforesaid Calendar Case, he restricts his prayer seeking dispensation of personal appearance of the petitioners/Accused No.4 before the Court below. 4.

Having regard to the facts and circumstances of the case and considering the request of learned counsel for the petitioners, without expressing any opinion on the merits of the case, the personal appearance of the petitioner/Accused No.4 in P.R.C.No.22 of 2016 on the file of Judicial Magistrate of First Class, Metpalli, is only dispensed with, while permitting him to make his appearance through counsel. However, the petitioners/Accused No.4 shall appear before the Court below as and when his personal appearance is so warranted,

in respect of the aforesaid Calendar Case and the trial Court shall proceed with the matter.

Miscellaneous petitions pending, if any, shall stand closed.
