THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI Writ Appeal No.139 of 2018 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} Heard Sri K.Pavan Kumar, learned counsel for the appellant (respondent No.7 in the writ petition), and Sri P.Vishnuvardhana Reddy, learned counsel for the 1st respondent-writ petitioner. After arguing for some time Sri K.Pavan Kumar, learned counsel for the appellant (respondent No.7 in the writ petition), would fairly state that the appellant would avail his common law remedy of filing a Suit before the Civil Court of competent jurisdiction and it would suffice if the suit is decided without being influenced by any observations in the order under appeal.
In the light of the aforesaid submissions of the learned counsel, the Writ Appeal is disposed of, leaving it open to the appellant herein to avail his common law remedy of filing a Suit before a Civil Court of competent jurisdiction. Suffice it to make it clear that, in case the appellant herein avails any such remedy, the Civil Court shall adjudicate his claim, strictly in accordance with law, without being influenced by any observations made either in the order under appeal or in the order now passed by us.
The Writ Appeal is disposed of accordingly. Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
