HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.19690 of 2009 ORDER:

The grievance of the petitioners is that the impugned order dated 12.09.2009, requesting the Divisional Engineer (Operations), APNPDCL, Warangal to disconnect power supply to the cell towers, was passed without putting them on notice and without giving them an opportunity of being heard.

The fact that no notice preceded the impugned proceedings is not in dispute. Suffice it, therefore, to set aside the impugned order, direct that the said order be treated as a show-cause notice, and permit the petitioners to submit their reply thereto within four weeks from today. The respondents shall pass appropriate orders in accordance with law within two months from the date of receipt of the petitioners reply. Till orders are passed on the petitioners reply to the show-cause notice, the earlier interim order dated 15.09.2009 shall continue to remain in force.

The Writ Petition is, accordingly, disposed of.

The Miscellaneous Petitions pending, if any, shall also stand disposed of. No order as to costs.
