2018-01-25T. Rajani1 pages

SMT JUSTICE T.RAJANI CRIMINAL PETITON No.424 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A2 and A3, in Crime No.261 of 2017 on the file of Vemulawada Police Station, Rajanna (Sircilla) District. The offences alleged are under Sections 354-A r/w 34 IPC and Section 12 of POCSO Act, 2012.

2.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

3.

The counsel for the petitioners submits that A1 in this case was already enlarged on bail. But the nature of the allegations do not entitled these petitioners for grant of anticipatory bail, as they along with A1 misbehaved with the defacto complainant. 4.

Hence, in view of the above allegations, this court opines that this is not a fit case for granting anticipatory bail. 5.

Accordingly, the Criminal Petition is dismissed. However, the petitioners can file a petition seeking for regular bail by surrendering themselves before the court below. The court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
