Petition Under Section 438 of Cr.P.C praying that in the circumstances stated in the Memorandum of Grounds of Criminal Petition, the High Court may be pleased to enlarge the petitioners on anticipatory bail and pass an order or orders in the event of their arrest in connection with Crime No.121 OF 2023 P.S.Chowdariguda, Cybarabad District, for an alleged offence punishable under Section- U/S.304(A) of lPC, during the pendency of enquiry and trial. This Petition coming on for hearing, upon perusing the Memorandum of Grounds ol Criminal Petition and upon hearing the arguments of Sri RAMESH BURA, Advocate for the Petitioner and the Public Prosecutor on behalf of the Respondent.

This Criminal Petition is filed under Section 438 of Cr'P'C' by petitioner/ accused seeking anticipatory bail in the event of his arrest in connection with Crime No'121 of 2O2i on the file of the Chowdariguda Police Station' Cyberabad' registered for the offence I I punishable under Sections 304-A of Indian Penal Code (for short 'rPC).

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentstate and perused the record.

On perusal of the record' since the pqnishment prescribed for the offence alleged against this petitioner is less than seven years' this Court deems it appropriate to direct the Investigating Officer in Crime No.121 of 2O2j, on the file of the Chowdariguda Police Station, Cyberabad District' to follow the procedure laid down under Section 41-A Cr'P'C and also the guidelines formulated by

re the Hon'ble Supreme Court in Arnesh Kumar o. State of Bihart scrupulously. However, the petitioners shall co-operate with the Investigating Officer by furnishing inJormation and documents as sought by him in concluding the investigation. 4.
