THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34364 of 2013 ORDER:
Respondent No.3 issued a notification calling for the applications from the eligible candidates from various villages including Kotapalli village, Tankalu Mandal, Anantapur District for filling up the post of Anganwadi worker vide notification dated 12.11.2011. As per the said notification, the applicant should have passed 10th class and should be a local married women within the age of 35 years. The petitioner and respondent No.6 applied for the said post. An interview was conducted and it was stated that respondent No.6 got 41.05% marks, whereas the petitioner got 33.07% marks. The present writ petition was filed on the ground that respondent No.6 had filed a false service certificate issued by the Mandal Educational Officer, Amadagur Mandal, Anantapur District and the petitioner got the said information under the Right to Information Act.
In spite of the service of notice on respondent No.6, none appeared for respondent No.6.
A counter affidavit is filed stating that during the verification of records it was noticed that the Mandal Educational Officer, Amadagur gave a written statement stating that respondent No.6 did not work under his control at any point of time and hence, the certificate was bogus. In those circumstances, they stated that the selection would be reviewed and necessary steps would be taken for taking disciplinary action against respondent No.6. It is
also stated that the petitioner obtained 33.07% marks, whereas respondent No.6 obtained 41.05% marks.
In view of the admission made in the counter affidavit, respondent No.3 is directed to review the case, as stated in the counter affidavit, and pass appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.
Accordingly, this Writ Petition is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
