THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLR SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION NO.9843 OF 2015 ORDER: {Per the Hon'ble Sri Justice Ramesh Ranganathan} This Writ Petition is preferred against the order passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.1048 of 2015 dated 16.02.2015. By the said order, the Tribunal admitted the O.A. and issued notice to the respondents returnable in four weeks.

The petitioner cannot be said to be aggrieved by issuance of a notice as his request, for grant of interim relief, would be heard after notice is served on the respondents. In view of the law declared by the Supreme Court in L.Chandra Kumar v. Union of India, ordinarily, the jurisdiction of this Court, under Article 226 of the Constitution of India, cannot be permitted to be invoked in cases where the Tribunal has deferred passing of orders, in interlocutory applications, till the respondents are put on notice and are given an opportunity of being heard. The Writ Petition fails and is, accordingly, dismissed. There shall be no order as to costs.
