THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.765 of 2024 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C.
by petitioners/Accused Nos.1 and seeking anticipatory bail in the event of their arrest in connection with Crime.No.5 of 2024 on the file of P.S.Neradigonda, Adilabad District, registered for the offence punishable under Section 306 r/w 34 of the Indian Penal Code (for short 'IPC'). 2.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The wife of the deceased filed the complaint alleging that these petitioners are responsible for the commission of suicide by the husband. In fact a letter was written by the deceased addressed alleging that these petitioners and two others are responsible for his death. The said suicide letter was produced by the learned Additional Public Prosecutor and in the said
letter, it is written that since the Court cases were filed, he is committing suicide.

Prima facie, the reason for committing the suicide is the pending civil disputes before the Civil Court. For the said reason, this Court is inclined to grant the relief of anticipatory bail to the petitioners, subject to the following conditions:-
1) The petitioners/Accused Nos.1 and 2 are directed to surrender before the Station House Officer, Neradigonda Police Station, Adilabad District on or before 31.01.2024. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) each with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioners/Accused Nos.1 and 2 shall appear before the concerned police on every Monday for a period of four (04) weeks for the purpose of investigation and thereafter, as and when required.
3) The petitioners/Accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
