THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.2225 of 2014 ORDER:

This Contempt Case was filed against the final order passed in W.P. No.12132 of 2002 dated 20.06.2013. The petitioner applied for the post of Assistant Secretary (Academics) and she was selected as such. She was appointed on 06.04.1999 and she joined service on 19.05.1999. Thereafter, the Andhra Pradesh Residential Educational Institutions was bifurcated and a Tribal Welfare Residential Educational Institutions known as Gurukulam was constituted. The petitioner is the third senior most trained graduate teacher among 45 trained graduate teachers, who are allotted to the Gurukulam Society. After expiry of the period of deputation, she submitted a representation on 11.02.2002 to the Member Secretary of Gurukulam followed by an appeal to the Chairman on 23.04.2002 seeking absorption as Assistant Secretary (Academics) and when the same was not considered, she filed W.P.No.8746 of 2002. The said writ petition was disposed of by order dated 30.04.2002 directing the respondents to consider the said representation and pass appropriate orders.

Pursuant to the same, an order dated 01.07.2002 was passed rejecting the appeal filed by petitioner. She was relieved on 02.07.2002. When the same was challenged in the above W.P.No.12132 of 2002, this Court set aside the said order and directed the respondents to continue the petitioner in service as an Assistant Secretary (Academics) making it clear that she is not entitled for any monetary claims arising there from for the period when she has not actually rendered her services to the Society. When the said order is not implemented, the present

Contempt Case is filed.

After hearing the learned counsel on both sides, an order was passed by this Court on 15.07.2016 noticing that consequent to the order in W.P.No.12132 of 2002 dated 01.07.2002, an order of reversion was passed on 13.11.2014 reverting one R.Lokendran, who filed W.P.No.34686 of 2014, and this Court granted interim suspension of the said order on 14.11.2014. However, the said Lokendran is now sent on deputation on 13.04.2016 for a period of one year and the post of Assistant Secretary (Academics) is vacant as on today. The case was adjourned in order to enable the learned counsel for the respondents to get instructions.

Learned counsel for the respondents submits that the Society will be passing appropriate orders accommodating the petitioner in the vacant post of Assistant Secretary (Academics). Recording the said submission of learned counsel for the respondents, this Contempt Case is closed. However, in view of the inordinate delay, appropriate orders shall be passed within a period of two (2) weeks from the date of receipt of a copy of this order, failing which it is open to the petitioner to renew the Contempt Case. No order as to costs.
