THE HON'BLE SRI JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT APPEAL No.1126 of 2006 JUDGMENT: (Per Hon'ble Sri Justice Dilip B. Bhosale) Heard learned Counsel for the parties.

On last occasion we heard this Writ Appeal for some time, and in the course of hearing some suggestions were made. Today learned Counsel for the parties have agreed for the following order: i) Writ Appeal is disposed of as not pressed. ii) The statement made by learned Counsel for the respondents that if the appellant makes an application for his appointment on contract basis within a period of ten days from today, the respondents shall appoint him, subject to medical fitness, within a period of three weeks therefrom and in any case from 1st of March, 2015. His statement is recorded and accepted.

iii) Learned Counsel for the appellant submits that the appellant shall make an application to the respondents, as aforementioned, within a period of ten days from today. His statement is also recorded and accepted.

iv) It is made clear that the appellant shall not be entitled to any monetary benefits of whatsoever nature as well as continuity of service on the basis of the earlier services rendered by him as a casual conductor.

With these observations, the Writ Appeal is disposed of. The miscellaneous petitions, if any, stand disposed of. No costs. ______________________
