THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.12544 of 2013 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, being aggrieved of non-consideration of the petitioner's representation, dated 28.03.2013, seeking cancellation of permission accorded to third parties and requesting to stop illegal construction in the park space of the subject lay out as per approval of VUDA.

At the hearing, learned counsel for the petitioner would submit that if a direction is given to the respondents to consider and dispose of the representation in strict accordance with the procedure established by law, the grievance of the writ petitioner would be redressed and the ends of justice would be met. Learned Standing Counsel for the GHMC would submit that the Corporation is prepared to take appropriate action, if necessary, in accordance with the procedure established by law, however, after considering appropriately the representation of the petitioner.

Recording the submissions, the Writ Petition is disposed of directing the respondents to consider the representation, dated 28.03.2013, of the writ petitioner appropriately and in strict accordance with the procedure established by law and take appropriate action in the matter, if necessary, as contemplated under law. In the facts and circumstances of the case, the respondents concerned shall complete the needful exercise and

communicate the decision taken to the writ petitioner within a month from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
