THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1417 of 2018 ORDER:
In this writ petition, the grievance of the petitioner is that the respondent Company is not releasing the power supply to the building in question on the ground of not producing Occupancy Certificate.
Heard learned counsel for the petitioner and learned Standing Counsel for Southern Power Distribution Company of Telangana Limited and perused the material on record and also the orders passed by this Court in similar circumstances. It is brought to the notice of this Court that by order, dated 13.02.2017 in WPMP.No.3057 of 2017 in Writ Petition No.2608 of 2017, this Court directed the respondents therein to release the power supply to the building of the petitioner therein subject to the compliance of the terms and conditions of supply of the respondents and the same can be withdrawn if an occupancy certificate was not obtained later from the municipal authorities. In view of the above, this writ petition is disposed of with a direction to respondents 2 and 3 to release the power supply to the building of the petitioner subject to the compliance of the
CKR, J W.P.No.1417 of 2018 terms and conditions of supply and on furnishing an undertaking to produce the Occupancy Certificate from the municipality/municipal corporation concerned within three months, and if no such Occupancy Certificate is produced within such period, it is open to respondents 2 and 3 to take appropriate action against the petitioner in accordance with law. Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
