THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE DR JUSTICE SHAMEEM AKTHER Writ Petition No.11081 of 2017 ORDER: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} The petitioner's grievance in this writ petition is to declare the action of respondents 2 to 7 in failing to prevent the 8th respondent from operating the rice mill in the residential locality, inspite of objections made by him before the respondents, as illegal and arbitrary.

Reference is made by Sri D.Narasimha Rao, learned counsel for the petitioner, to the proceedings of the A.P. Pollution Control Board dated 26.06.2015 requesting the Tahsildar, Karamchedu Mandal, Prakasam District to initiate necessary action against the rice mills, which were located in Swarna Village and were causing public nuisance under Section 133 Cr.P.C, and to direct them not to operate until they provided adequate store room for storage of husk, and to close the openings to control air pollution on the immediate surroundings, in the interest of public health and environment.

Learned Government Pleader for Revenue, on instructions from the Tahsildar, states that a notice has already been issued to the defaulting units asking them to show cause why the units should not closed; and final orders would be passed within ten days from today.

Recording the submission of the learned Government Pleader, on instructions from the Tahsildar, the Writ Petition is closed. On an order being passed by the Tahsildar, within ten days from today, a copy thereof shall also be made available to the
