SMT JUSTICE T.RAJANI CRIMINAL PETITION No.439 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of bail to the petitioner, who is accused No.3, in Crime No.14 of 2017 on the file of the Station House Officer, Mothugudem Police Station, East Godavari District. 2.

The offences alleged are under Sections 8(c) R/w.20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the Act').

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.

Learned Public Prosecutor brings to the notice of this Court the fact of dismissal of the earlier bail applications of the petitioner/accused No.3. Recently, this Court, while dismissing the earlier bail application of the petitioner, by virtue of the orders in Criminal Petition No.11086 of 2017, considered the merits of the case and also made a categorical observation that the gravity of the offence is high and it cannot be said that the prosecution case is false. Hence, when such is the observation made by this Court earlier, now this Court cannot get over the hurdles laid under Section 37 of the Act, in order to grant bail to the petitioner. Hence, the Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
