THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM W.P.No.1884 of 2019

ORDER

The order dated 02.01.2019 passed by the 3rd respondent Sub-Collector, Khammam, whereby the authorization of the petitioner's fair price shop dealer of Shop No.2281019 at D.No.5-4-60, Pakabanda Bazar, Khammam District, was cancelled, is under challenge in this Writ Petition.

Learned counsel for the petitioner fairly submits that as against the order dated 02.01.2019, the petitioner has preferred an appeal before the 2nd respondent-Joint Collector on 04.01.2019 along with stay application.

Learned Government Pleader for Civil Supplies for respondents would submit that inasmuch as the appeal filed by the petitioner is pending, the appellate authority may be directed to dispose of the same.

In the circumstances, having considered the submissions made on either side and also having regard to the nature of the allegation made against the petitioner that he is indulging in clandestine business diverting the stock into black market, the 2nd respondent- Joint Collector is directed to consider and dispose of the appeal within four weeks from today. If the 2nd respondent fails to decide the appeal within the timeframe, the petitioner's authorization

CKR, J W.P.No.1884 of 2019 to run the fair price shop shall be restored till the disposal of the appeal.

With the above direction, the Writ Petition is disposed of. No costs. Miscellaneous applications, if any pending in this writ petition, shall stand closed.
