THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 1664 of 2019 O R D E R:

Petitioner asserts that his vehicle bearing No. AP 29 TB 3116 was seized by respondent No.3-Assistant Motor Vehicles Inspector, D.T.O. Nagar Kurnool on the ground that it is transporting 15 passengers as a stage carriage and the petitioner has not produced necessary documents.

Heard learned counsel for the petitioner and learned Government Pleader for Transport for the respondents. Having regard to the fact that the vehicle of the petitioner was seized by respondent No.3 on the ground that he has not produced necessary documents, the writ petition is disposed of with the direction to the respondent authorities to release the vehicle in question, subject to the petitioner paying tax along with penalty, if any, as assessed by respondent No.2-District Transport Officer, forthwith. However, such payment shall be subject to the final orders that may be passed by respondent No.2 by following due process of law.
