THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.2107 of 2015 ORDER:

There is no representation on behalf of the petitioner. The prayer sought for in this writ petition is as under: "....to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondent 3 in receiving the Complaint (Ex. P1) and refusing to issue the acknowledgement in proof of receipt of the same and further inaction by way of not even warning the Respondents-4 and 5 though the complaint contains life threat to the minor, his property and his family members as illegal, arbitrary and violative principles of natural justice, equity and good conscience besides also violative of Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondents to receive the Complaint (Ex.P1) forthwith and issue acknowledgement in proof of receipt of the same and initiate immediate action rendering protection to the minor-petitioner and his family members besides protecting his minor-property too from the greedy and lawless respondents 4 and 5 in the interest of justice."

When the matter is called, the learned Govt.Pleader appearing for the respondent Nos.1 to 3 placed on record the latest written instructions, dt.27.09.2019 issued by the Sub Inspector of Police, Mancherial Police Station, Mancherial District. A perusal of the said written instructions would reveal that the mother of the petitioner lodged a private complaint against the respondent Nos.4 and 5 herein on the file of the Court of II Addl.Judicial Magistrate of First Class, Mancherial (for short, 'the Magistrate') with regard to

misappropriation, abusive language and criminal intimidation. Pursuant to the complaint, a case in Cr.No.392 of 2015, dt.05.12.2015 was registered for the offences punishable under Sections 406, 504 and 506 read with 34 IPC against the respondent Nos.4 and 5. During the course of investigation, as many as six (6) witnesses including the petitioner herein were examined and recorded their detailed statements. After completion of the investigation, a chargesheet was also filed on 12.01.2016. The learned Magistrate, after taking cognizance of the offences, numbered the case as C.C.No.22 of 2016.

The written instructions would reveal that the complainant as well as Accused Nos.1 and 2 approached the Lok Adalath and the matter was compromised on 30.07.2016. A Photostat copy of the daily status report of Junior Civil Judge's Court, Mancherial is enclosed to the said written instructions reveal that the accused are acquitted for the above said offences.

In view of the same, this Court is of the opinion that no further cause would survive in the Writ Petition. Accordingly, the Writ Petition is closed.

No costs.
