This writ petition is filed for the following relief; "...to issue a appropriate writ, order or orders, more particularly one in the nature of writ of mandamus to the respondent No.2 not to insist no objection certificate (NOC) for alienating the property as it is patta land of Petitioner of the land in Survey No.345/4 to an extent of Ac.3.0 guntas situated at Mancherial Village, Mancherial District, consequently insisting of NOC for the above land is illegal, arbitrary and violative of Article 21 and 300-A of the Constitution of India and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and in the interest of Justice."
Heard both sides.
When once it is stated that the subject land is an assigned land, this Court cannot direct the authorities not to insist for No Object Certificate for alienating the subject land, as rightly contended by the learned Assistant Government Pleader for Revenue. In view of the same, no relief can be granted in this writ petition. Accordingly, the writ petition is dismissed. No order as to costs.
