THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.2253 OF 2009 ORDER:

The present writ petition was filed challenging the Award dated 29.01.2004 in I.D.No.113 of 2001 passed by the Labour Court-III, Hyderabad, in respect of the first respondent, who was working as a conductor in the petitioner Corporation. The services of the first respondent was terminated on 11.08.1999 and after unsuccessful attempts in appeal, he raised I.D.No.113 of 2001 challenging the order of removal, dated 11.08.1999. The Tribunal by its Award, dated 29.01.2004, set aside the order of removal and directed reinstatement of the first respondent with continuity of service, with deferment of two Annual Grade Increments with cumulative effect but without back wages and attendant benefits.

This Court, by order, dated 04.11.2009 granted stay only to the extent of continuity of service awarded by the Labour Court and it was observed that the payment of the increments to the first respondent would be subject to the result of the writ petition. Now it is brought to the notice of this Court that the first respondent was superannuated and his terminal benefits were also settled. In view of the same, the writ petition has become infructuous and no useful purpose would be served by examining the matter.

The writ petition is accordingly closed.
