THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.4021 of 2004 ORDER:
This Writ Petition was filed for issuance of writ of Mandamus directing that the orders in Case No.3816 dated 26.12.1975 passed by the Settlement Officer, Rajahmundry are binding on the respondents and not to disturb the possession of the petitioner from the land in survey No.69/2(p) in an extent of Ac.1-85 cents, situated at Venkatapuram Village and Mandal, Khammam District.
2. It is represented by the learned counsel for the petitioner as well as the learned Government Pleader for Revenue that the connected Writ Petition No.4012 of 2004 was disposed of on 09.04.2014.
3. In view of the consent expressed by both the counsel, this Writ Petition is also disposed of in terms of the order in W.P.No.4012 of 2004 dated 09.04.2014 which reads as follows:
"...As regards the possession of the petitioner is concerned, the respondent admits that the petitioner is in possession of the property. The possession of petitioner shall not be disturbed except in accordance with law, only after issuing notice to the petitioner, receiving explanation and passing appropriate orders thereon. As and when a notice is issued, it is left open to the petitioner to bring to the notice of the respondent the order of Settlement Officer dated 26.12.1975 and it is for the authorities to take appropriate action in accordance with law on the effect of Settlement Officer order dated 26.12.1975. Till the above said exercise is completed, status quo as on today shall be directed to be maintained by the parties."
4. The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. _____________________________________ JUSTICE A.RAMALINGESWARA RAO
