THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.9946 OF 2006 ORDER:

This Writ Petition came to be filed to declare the proceedings bearing No.WL/T/NARSAMPET, dated 25.04.2006, issued by the 2nd respondent, as arbitrary and illegal.

2. The petitioner herein was a Dealer of respondent No.1 Corporation. While things stood thus, in the month of November, 2005 the representative of respondent No.1 Corporation conducted routine inspection and found that the petitioner was completely neglecting the dealership affairs and on many occasions it was noticed that the petitioner was not present in the retail outlet and left the entire affairs of the Dealership at the hands of some unknown persons, who were neither recognized nor approved by the Corporation. It was also observed that the petitioner was regularly flouting the instructions given by the 1st respondent Corporation from time to time. Hence, the impugned order came to be passed giving certain instructions since the petitioner has flouted the terms and conditions of the BPCL. Challenging the said impugned order, dated 25.04.2006, the present writ petition is filed.

3. On 23.05.2006 this Court while issuing Rule nisi suspended the impugned order for a period of two months. Thereafter, on 15.06.2007 a learned Single Judge of this Court while holding that there is no interim order as on that date and since the dealership of the petitioner was cancelled in 2006 itself, closed the W.P.M.P.

4. In that view of the matter, nothing survives in the Writ Petition for further adjudication at this point of time.

5. Accordingly, the Writ Petition is closed leaving it open the

remedies, if any, available to the petitioner under law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
