THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.21746 of 2017 ORDER:
The petitioner calls in question proceedings in R.Dis.D2/1930/2015, dated 20.12.2016, as illegal, arbitrary and without jurisdiction.
The issue arises under A.P. Rights in Land and Pattadar Passbooks Act, 1971 (for short 'the Act'). The order dated 20.12.2016, in the considered view of this Court, can be effectively challenged under Section 9 of the Act before the District Collector, who has revisional jurisdication to examine the regularity, correctness, legality or propriety of any decision taken, order passed or proceedings made in respect thereof in record of rights.
Learned counsel requests three weeks time to file revision under Section 9 of the Act.
Request is accepted. Petitioner is given liberty to file revision by enclosing a copy of this order within three weeks from today. The petitioner if files revision as permitted by this Court, the District Collector/Joint Collector is directed to entertain and dispose of the revision within six months thereafter. The parties are directed to maintain status quo as on date as regards the entries in 1B register for a period of four weeks from today. The petitioner to obtain further orders in the revision filed before District Collector.
With the above observations, the Writ Petition is disposed of. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
