HON'BLE SRI JUSTICE A.SHANKAR NARAYANA M.A.C.M.A.No.1027 of 2005 JUDGMENT:

The instant appeal is listed today, under the caption 'for dismissal'. During the forenoon session, while making mentions, some learned counsel on behalf of learned counsel for the appellant requested to pass over the matter. It was made clear that after completion of item No.12, it will be taken up. Even in the forenoon session at 2.45 p.m. also, there is no representation for the appellant.

Sri Meherchand Nori, learned counsel for respondent No.2 has been waiting through out.

Hence, the appeal is dismissed for non-prosecution. No order as to costs.

As a sequel, the miscellaneous applications pending, if any, shall stand closed.
