This Criminal Revision Case is filed aggrieved by the Judgment dated 24.02.2010 on the file of learned Judicial Magistrate of I Class, Special Mobile Court cum XI Metropolitan Magistrate, Cyderabad, L.B.Nagar in C.C. No.1086 of 2006 (Old C.C. No.1171 of 2005 on the file of learned II Metropolitan Magistrate, Cyderabad), wherein the respondents No.2 and 3/Accused found not guilty for the offence punishable under Section 498 - A of Indian Penal Code and were acquitted under Section 248 (1) of Criminal Procedure Code.
02. No representation on behalf of respondents No.2 and 3. Ms. P.Deepika, learned counsel appearing on behalf of Sri Bijetha Borukatti, learned counsel for the Petitioner, on record as well as Sri S.Ganesh, learned Assistant Public Prosecutor representing the State/Respondent No.1 are present.
03. It is submitted by Ms. P.Deepika, learned counsel appearing on behalf of Sri Bijetha Borukatti, learned counsel for the Petitioner, on record, that the petitioner and respondent No.2 are living together as wife and husband under one roof, after settling the issues. Therefore, the learned counsel for the Petitioner sought permission of this Court to withdraw this Criminal Revision Case.
04. In view of the above submission, permission is accorded and this Criminal Revision Case is liable to be dismissed.
05. Accordingly, this Criminal Revision Case is dismissed as withdrawn. There shall be no order to as costs.
As a sequel, pending Miscellaneous Applications, if any, shall stand closed.
